Legal protection for everyone
- KINEOPASS is a Brazilian platform that acts as an INTERMEDIARY in the sale of registrations for amateur sporting events in Brazil and abroad;
- The USER is interested in purchasing a registration for an event being marketed by KINEOPASS.
Terms of use for the user who wishes to register for an event
As a user of the KINEOPASS system, you declare that you are aware of and accept the following clauses and conditions.
1. Be aware that
- All content — text, photos, and videos — of events published on KINEOPASS is the full responsibility of the event ORGANIZER, whose information appears on the event page. KINEOPASS exercises no prior control or supervision over such content.
- The ORGANIZER is solely responsible for the planning, organization, and execution of the event, defining attractions, schedule, location, dates, registration prices, available spots, minimum and maximum ages, possible discounts, and other particulars.
- Any change to the event program — dates, location, or cancellation — as well as any occurrence during the event, is the sole and exclusive responsibility of the ORGANIZER.
2. Accuracy of data
All information declared in the system registration and in the purchase of registrations through KINEOPASS is true and complies with applicable laws.
3. Event regulations
You are aware of and agree with the RULES, REGULATIONS, and AGREEMENT TERMS of the events disclosed on KINEOPASS in which you may participate.
4. Physical fitness
You have the technical skills and are physically fit to participate in the events you purchase on KINEOPASS, releasing KINEOPASS and the ORGANIZER from any health issue that may occur due to your participation.
5. Registration on behalf of third parties
In the event you are registering on behalf of third parties: you hold all rights of representation of such third parties, with authorization to provide their registration data. You declare that the third party who will participate in the event has the technical skills and is physically fit, releasing KINEOPASS and the ORGANIZER from any issue that may occur due to the participation of the third party.
6. Image rights
You authorize the use of your image rights — and those of the third parties registered by you and from whom you hold authorization — for promotion and disclosure of the event, by the ORGANIZER, KINEOPASS, and sponsors.
7. Payment confirmation
You are aware that simply placing an order on KINEOPASS does not guarantee your entry to the event nor does it guarantee your right to pick up any kits. These rights are guaranteed only upon confirmation of payment of the full amount charged, in the case of Pix; or upon authorization given by the credit card to debit the full amount due, in the case of credit cards.
8. Divergent payment
Any payments made in an amount different from what is actually due (whether lower or higher) will NOT generate a valid registration nor guarantee your entry to the event, nor entitle you to the pickup of any kits related to the event.
9. Kit pickup
If the registration entitles you to kit pickup, kits may only be picked up on the dates and times set by the ORGANIZER and stated on the "event presentation and registration page" of the event. Failure to pick up kits on the established dates will result in the LOSS OF YOUR RIGHT to pick up said kits.
10. Right to withdraw (Brazilian Consumer Defense Code, art. 49)
In case of withdrawal from purchase, regardless of the reason, a refund of the amount paid will be made provided the request is made within 7 (seven) calendar days of the order date AND provided there are at least 7 (seven) days remaining before the event start (or kit delivery, where applicable). Both requirements must be met cumulatively.
It is expressly established that:
- a) Refunds will NOT be issued for requests made after the 7 (seven) day window from the purchase date, even if the request occurs 7 (seven) or more days before the event start;
- b) Refunds will also NOT be issued for requests made within the 7 (seven) day window if the request occurs less than 7 (seven) days before the event start or kit delivery, where applicable.
11. Refund method
In cases where a refund is applicable for cumulatively meeting both requirements of item 10: if the order was paid via Pix, the refund will be made to a bank account informed by the order holder within up to 30 business days; if the order was paid by credit card, the refund will be credited to the same card used, in the current or subsequent statement.
The refund request must be made in writing via email to contato@kineopass.com.br, providing the order number, name, identification document (CPF in Brazil), and email of the order holder.
12. Optional extended refund benefit
12.1. KINEOPASS makes available to its Users, strictly optionally at the time of purchase (checkout), the "Extended Refund" service.
12.2. The benefit consists of the possibility for the User to request the cancellation of the registration and the refund of the ticket/registration amount up to 7 (seven) days before the event date, regardless of the legal withdrawal period.
- Sole paragraph: Requests made less than 7 (seven) days before the event start are not eligible for the benefit, and the platform's standard retention rules and legal cancellation periods apply.
12.3. Retained and non-refundable amounts:
- Activating the "Extended Refund" requires payment of a service fee equivalent to 12% (twelve percent) of the total registration/ticket amount contracted.
- The User acknowledges that, if the benefit is triggered, the refund will not include:
- The amount paid for the Extended Refund benefit itself (the 12%);
- The platform's standard Service Fee charged at the time of the original purchase.
- The amounts described above relate to the technology services already used by the User and will not be refunded under any circumstances.
12.4. Procedure and refund deadline:
- How to request: To trigger the benefit, the User must access their Athlete Area, locate the details of the corresponding registration, and follow the on-screen instructions to complete the refund request.
- Payment deadline: After the platform validates the request, the deadline for the actual refund of eligible amounts is up to 30 (thirty) calendar days.
12.5. Processing and financial responsibility:
- KINEOPASS acts strictly as the technology platform that manages the user experience, the Athlete Area, and provides the commercial rules described in this clause.
- All financial transactions, receipts, and the settlement of refunds arising from the Extended Refund are processed securely through the regulated infrastructure of the partner payment institution ASAAS GESTÃO FINANCEIRA S.A.
13. Liability for the event
You release KINEOPASS from any liability related to the event. Any claims — such as, but not limited to, refund requests outside the window in item 10, registration cancellations, postponements, event cancellations, or any other event-related matters — must be addressed directly to the ORGANIZER.
14. Cancellation outside the withdrawal window
Cancellation of event participation, when the requirements set forth in item 10 are not met, is only possible in the cases and conditions established by the ORGANIZER in the event's Regulations, and must be requested directly from them. Where possible, the refund will occur on the terms determined by the ORGANIZER.
15. Third-party content
You release KINEOPASS from any liability related to links existing on the KINEOPASS site or to content signed by third parties — such as columns, blogs, comments, videos, photos, training maps — which are the sole responsibility of their authors.
16. Intellectual property
The reproduction of any content disclosed on KINEOPASS is prohibited, whether in whole or in part, for commercial, personal, or editorial use, except with prior written authorization from KINEOPASS or from the author when identified.
17. Contact and forum
- a) Any contact with KINEOPASS may occur via email at contato@kineopass.com.br;
- b) The relationship with KINEOPASS is governed by Brazilian law;
- c) Any dispute shall be resolved in the competent Brazilian jurisdiction.
18. Event regulations
You acknowledge that the specific rules of the event are governed by the Regulations prepared by the organizer and available on the event page on KINEOPASS.
19. Financial services and payments
The financial and payment services made available through this platform — including the opening and maintenance of a payment account, transaction processing, issuance of bank slips (boletos), transfers, payments, and other movements of funds — are provided by ASAAS GESTÃO FINANCEIRA INSTITUIÇÃO DE PAGAMENTOS S.A., a payment institution authorized to operate by the Central Bank of Brazil.
KINEOPASS acts exclusively as a technology integrator and distributor of the product experience, and is not a financial or payment institution, nor does it carry out financial intermediation in its own name.
The customer acknowledges that the financial/payment relationship and the regulatory responsibility for the services described above belong to ASAAS GESTÃO FINANCEIRA S.A., under the applicable regulations.
These terms may be modified at any time. Relevant changes will be communicated through the platform channels and/or by email, and will be valid for events occurring after the publication of the new version.
